1. Introduction

Everblack (“we,” “us,” or “our”) is committed to protecting the privacy of our users. This Privacy Policy explains how we collect, use, share, and protect information in connection with the Everblack platform (“Service”). By using the Service, you agree to the practices described in this Policy. The Service is intended for business use and is not directed at consumers or individuals under 13 years of age.

2. Information We Collect

We collect information you provide when creating an account, including business name, contact name, and email address. We also collect order, inventory, and invoice data you enter into the platform, as well as payment information processed through Stripe (we do not store full payment card numbers). We may collect usage data such as login activity, pages visited, and features accessed for platform improvement and security purposes. If you connect QuickBooks, we access only the data necessary to provide synchronization features.

3. How We Use Your Information

We use your information to: provide and operate the Service; process payments and manage subscriptions; send transactional communications including order confirmations, invoices, and account notices; improve platform performance and reliability; detect and prevent fraud, abuse, or security threats; and comply with applicable legal obligations. We do not sell your data to third parties for marketing purposes.

4. Data Sharing

We share data only with service providers necessary to operate the platform, including Stripe for payment processing and Intuit for QuickBooks synchronization. These providers are contractually bound to handle your data securely and only for the purposes of providing their services. We may also disclose data when required by law, court order, or to protect the rights and safety of Everblack or its users. We do not sell, rent, or trade your personal data.

5. Authentication & Session Data

We use session cookies and, where applicable, secure QR-based tokens to authenticate users and maintain login sessions. These are used solely for access control and expire automatically after a period of inactivity. We do not use tracking or advertising cookies.

6. Data Security

We implement industry-standard security measures including encrypted connections (HTTPS/TLS), hashed and salted passwords, brute-force login protections, CSRF protections, and secure session management. While we take reasonable precautions, no system is completely secure and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of your account credentials.

7. Data Retention

We retain your account and business data for as long as your account is active. Upon account cancellation, data is retained for 90 days before permanent deletion, unless you request immediate removal or applicable law requires a different retention period.

8. Your Rights

You may request access to, correction of, or deletion of your personal data at any time by contacting us at the address below. We will respond to verified requests within 30 days. Note that some data may be retained as required by law or for legitimate business purposes such as fraud prevention.

9. Limitation of Liability for Data Incidents

While we take reasonable steps to protect your data, Everblack is not liable for unauthorized access, data breaches, or loss of data resulting from circumstances beyond our reasonable control, including attacks on third-party infrastructure, user credential compromise, or force majeure events. Our total liability for any data-related claim is limited as described in our Terms of Use.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes via email at least 14 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Policy. If you do not agree to the revised Policy, you must stop using the Service before the effective date.

11. Governing Law

This Privacy Policy is governed by the laws of the State of Maine. Any disputes relating to this Policy shall be resolved in accordance with the dispute resolution provisions set forth in our Terms of Use.
